These Terms of Service govern your use of Notchlens Marketplace, a platform that connects buyers and sellers of camera gear. Notchlens is a neutral third-party facilitator and assumes no liability for transactions, shipping, or item condition.

Foundational Provisions
1. Acceptance & Eligibility
1.1 Contractual Agreement: By accessing, browsing, registering on, or using Notchlens Marketplace (accessible via notchlens.com, market.notchlens.com, or related mobile applications), you enter a legally binding agreement with Notchlens Global Alliance Ltd (RC 8886205), a company registered under the laws of the Federal Republic of Nigeria.
1.2 Age Requirement: You must be at least 18 years old to create an account or use the Platform. If you are between 13 and 18 years, you may only use the Platform under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms. The Platform is not directed to children under 13.
1.3 Capacity: You represent and warrant that you have the full legal capacity and authority to enter these Terms and that your use complies with all applicable laws, regulations, and third-party rights.
1.4 Account Information: You agree to provide accurate, current, and complete information during registration and to update such information promptly to maintain its accuracy. Provision of false or misleading information constitutes a material breach of these Terms.
1.5 Verification: Notchlens reserves the right to request identity verification, including but not limited to Bank Verification Number (BVN), National Identification Number (NIN), driver's license, or international passport, particularly for users seeking "Verified Seller" status or engaging in high-value transactions. Provision of such information is voluntary but may be necessary to access certain features.
2. Definitions

| Shop Owner | A Seller with a paid subscription to "My Shop" featuring a branded storefront |
| Content | All text, images, videos, listings, descriptions, reviews, and other materials uploaded to the Platform |
| NotchBar (NB) | The in-platform utility token used for fees, subscriptions, and promotions |
| Gear Vault | The user-controlled inventory and anti-theft registry feature |
| Transaction | Any agreement for the sale, purchase, or exchange of items between Users |
| Fees | Any charges imposed by Notchlens for use of Platform features |

⚠️ CRITICAL DISCLAIMER: Notchlens is a neutral third-party platform that facilitates connections between independent Buyers and Sellers. We do not participate in, verify, guarantee, or take responsibility for any Transaction. ALL TRANSACTIONS ARE SOLELY BETWEEN THE BUYER AND SELLER.
3. Role of Notchlens
3.1 Neutral Facilitator: Notchlens provides an online marketplace platform that enables Users to connect, communicate, list, discover, and transact regarding camera equipment and related accessories. Notchlens is NOT a party to any Transaction, does not hold title to any listed items, and does not transfer legal ownership from Sellers to Buyers.
3.2 No Agency Relationship: You expressly acknowledge and agree that:
- Notchlens is not an agent, broker, employee, or representative of any User
- No agency, partnership, joint venture, employment, or fiduciary relationship exists between Notchlens and any User
- All contracts for the sale of items are strictly bilateral agreements between Buyer and Seller
- Notchlens does not inspect, authenticate, evaluate, or endorse any listed items unless expressly stated in a separate, paid service agreement
- Notchlens does not guarantee the existence, quality, safety, legality, or authenticity of any item listed
4. What Notchlens Does NOT Do
Notchlens does not and will not:
- Handle Shipping: We do not ship items, arrange courier services, or take custody of any items being sold.
- Provide Insurance: We do not insure items during transit or against loss, theft, or damage.
- Escrow Services: We do not hold funds, provide payment escrow, or act as a payment intermediary.
- Inspect Items: We do not physically inspect, test, or verify the condition of any listed items.
- Authenticate: We do not authenticate the brand, model, or originality of any listed gear.
- Resolve Disputes: We are not responsible for resolving disputes between Buyers and Sellers.
5. User Acknowledgment of Risk
YOU ACKNOWLEDGE AND AGREE THAT:
- All Transactions are at your own risk
- You are solely responsible for verifying the condition, authenticity, and ownership of any item
- You are solely responsible for arranging and paying for shipping, insurance, and customs clearance
- You are solely responsible for any taxes, duties, or fees arising from your Transaction
- Notchlens provides no warranties, guarantees, or representations regarding any item, Seller, or Buyer
- Notchlens shall not be liable for any loss, damage, or injury arising from any Transaction
6. Transaction Best Practices
💡 Recommended Practices for Safe Transactions:
- Use the Gear Vault to verify serial numbers before purchase
- Request the Seller to add items to the Gear Vault with supporting documentation
- Meet in person when possible to inspect and test items before payment
- Request original receipts, packaging, and accessories where applicable
- Document the Transaction with photos, videos, and written agreements
- Use secure payment methods with buyer protection where available
- Arrange your own shipping insurance for valuable items

7. Listings & Content Standards
7.1 Listing Warranty: By listing an item on the Platform, you represent and warrant that: You are the lawful owner of the item or have express authorization from the owner to sell it; The item is not stolen, counterfeit, or obtained through fraudulent means; The item is not subject to any undisclosed lien, security interest, or third-party claim; All descriptions, specifications, images, and conditions provided are accurate, complete, and not misleading; The item complies with all applicable Nigerian laws and regulations.
7.2 Prohibited Items: The following items may not be listed on the Platform:
- Stolen goods
- Counterfeit products
- Items infringing intellectual property rights
- Weapons, ammunition, or explosives
- Illegal drugs
- Human body parts
- Obscene materials
- Items promoting violence or discrimination
- Any item whose sale is prohibited by Nigerian law
7.3 Image Standards: Listing images must accurately represent the actual item. Stock photos, misleading angles, or digitally altered images that misrepresent condition are prohibited. Sellers must disclose any significant damage, wear, or defects in both images and descriptions.
7.4 Pricing Accuracy: All prices listed are in Nigerian Naira (₦) unless otherwise specified. Sellers are responsible for ensuring prices are accurate and include all applicable taxes. Notchlens is not responsible for pricing errors made by Sellers.
7.5 Content License: By submitting Content to the Platform, you grant Notchlens a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such Content in connection with the Platform and Notchlens' business. This license continues even after you stop using the Platform, solely to the extent necessary for archival and legal compliance purposes.
7.6 Content Screening: Notchlens reserves the right, but has no obligation, to monitor, screen, or edit any Content. We may remove or refuse to post any Content that violates these Terms or is otherwise objectionable, in our sole discretion, without prior notice.
